Upstate New York Defective Product Lawyers
Every day in America, consumers purchase millions of different products – from car seats and highchairs to food and beverages, power tools to vehicles. You trust that the products you purchase are safe.
And, fortunately, there are safety standards in place to protect consumers. But, standards are not always met, and products do not always work as they were intended.
If you were harmed due to a dangerous or defective product, you have a legal right to hold manufacturers and others accountable for their negligence. If this happens to you, the responsible parties could be required to pay you compensation for your losses, including medical costs, lost wages, pain and suffering, and more.
Our personal injury lawyers know that injuries sustained due to dangerous and defective products are often severe and substantial. The physical, emotional, and financial toll can be devastating. The pain and trauma can be immense. Our personal injury lawyers will help you understand your rights and legal options. We will ensure the negligent parties involved are held accountable. And we will fight for the compensation you deserve – past, present, and future.
If you or someone you love have been injured by a defective product, let our Albany NY personal injury lawyers help you.

What is a Defective Product?
A defective product is a product with an imperfection caused either by faulty manufacturing or design, or a product that is sold with insufficient instructions or warnings.
What is Product Liability?
Product liability refers to the responsibility of any or all parties along the chain of manufacture of a product for damage caused to a person by that product.
Who Can Be Held Accountable for a Defective Product?
Any party involved in the manufacture, distribution, sale, and marketing of a product can be held liable, including:
- The manufacturer
- The assembler
- The distributor
- The supplier
- The wholesaler
- The retailer
- The servicer
- The marketer
Products containing inherent defects that cause harm to a consumer of the product would be the subjects of product liability suits.
Additionally, while products are generally thought of as tangible personal property, product liability also encompasses intangible and natural products, real estate, and writings distributed to consumers.

- Design defects are inherent, as they exist before the product is manufactured. While the item might serve its purpose well, it can be unreasonably dangerous to use due to a design flaw.
- Manufacturing defects occur during the construction or production of the item.
- Defects in marketing deal with improper instructions and failures to warn consumers of latent dangers in a product.

- Keep the defective product. It will be needed as evidence and for examination by an expert.

What to Know About the Consumer Product Safety Commission
The CPSC is an independent federal regulatory agency formed to protect the public against unreasonable risks of injury or death from consumer products through education, safety standards activities, regulation, and enforcement. The CPSC regulates the manufacture and sale of more than 15,000 different consumer products in the United States, from cribs to all-terrain vehicles and many things in between.
There are some products sold in the U.S. that the CPSC does not have jurisdiction over, including products that are specifically under the jurisdiction of other U.S. federal agencies.
In August 2008, Congress passed the Consumer Product Safety Improvement Act of 2008 (CPSIA), which required the CPSC to create a searchable public database of reports of harm related to the use of consumer products and other products or substances within CPSC’s jurisdiction. If you worry that a product you’re using has been deemed unsafe or recalled, the database can be found here.
