Adam’s presentation “No, That Witness is Not Going to Appear for Trial” focused on the post-Covid return to the courtroom. Specially, Adam spoke on the advent of videoconferencing witness testimony, the attempted use of Federal Civil Rules 43 and 45 to extend federal subpoena power to cyberspace to obtain jurisdiction over witnesses, strategies to fight these subpoenas, and how to prepare a witness when he or she is compelled to appear virtually at trial.
